Terms of Service

EcoleUp is an educational service for learners and families, including children under 16. If you create an account for a child, you accept these Terms on behalf of yourself and the child you authorize.
Acceptance of Terms
These Terms of Service are a legally binding agreement between you and EcoleUp governing access to and use of the EcoleUp application, website, and related services. By downloading, installing, or using the Service, you confirm that you are at least 18 years old or are a parent or legal guardian who accepts these Terms for a minor user.
Children and Parental Responsibility
Parents and guardians are responsible for supervising a child's use of the Service, ensuring compliance with these Terms, protecting account credentials, and reviewing the Privacy Policy and consent notices. Children under 16 may use the Service only with the express consent of a parent or legal guardian.
Account Registration
When registering, you agree to provide accurate information, keep credentials confidential, notify us at ecoleup2@gmail.com about suspected unauthorized access, and accept responsibility for activity under your account. We may refuse registration or terminate accounts that violate these Terms.
Permitted Use
EcoleUp may be used only for personal, non-commercial educational purposes. You must not use the Service unlawfully, attempt unauthorized access, reverse-engineer the application, copy or distribute content without permission, upload harmful or inappropriate content, impersonate others, use bots or scrapers, or disrupt the Service.
Intellectual Property
Educational lessons, exercises, graphics, audio, video, text, software, trademarks, and other EcoleUp content belong to EcoleUp or its licensors. We grant a limited, non-exclusive, non-transferable, revocable license for personal educational use. This license does not allow commercial copying, modification, sublicensing, or transfer.
User-Generated Content
If you submit content, you retain ownership of it. You grant EcoleUp a worldwide, royalty-free, non-exclusive license to use, store, and display that content only to operate and improve the Service. You represent that submitted content does not infringe third-party rights and complies with these Terms.
Subscriptions and Payments
EcoleUp may offer free and paid subscription tiers. Paid features are purchased through the Apple App Store or Google Play Store and are subject to their billing and refund terms. We do not process payment card information directly. Subscription cancellations must be managed through the relevant app store account.
Disclaimer of Warranties
The Service is provided as is and as available without warranties of any kind. We do not guarantee uninterrupted, error-free, or virus-free operation. Educational content is provided for general learning and may not be suitable for every curriculum or educational outcome.
Limitation of Liability
To the maximum extent permitted by law, EcoleUp and its officers, employees, and agents are not liable for indirect, incidental, special, consequential, or punitive damages arising from use of or inability to use the Service. Aggregate liability will not exceed amounts paid to EcoleUp in the preceding 12 months, if any.
Indemnification
You agree to indemnify and hold harmless EcoleUp and its affiliates from claims, damages, losses, liabilities, costs, and reasonable legal fees arising from your violation of these Terms or your use of the Service.
Termination
We may suspend or terminate access at any time for breach of these Terms or other legitimate reasons. You may delete your account through the app settings or by contacting ecoleup2@gmail.com. Provisions that should survive termination, including intellectual property, disclaimers, liability limitations, and indemnification, remain in effect.
Governing Law and Dispute Resolution
These Terms are governed by applicable law. Disputes should first be addressed through good-faith negotiation. If unresolved within 30 days, disputes may be submitted to binding arbitration or, where arbitration is not permitted, to a court of competent jurisdiction.
Changes to These Terms
We may update these Terms and will notify users of material changes by in-app notice or email where required. Continued use after the effective date means acceptance of the revised Terms. If you disagree, stop using the Service and delete your account.
